How does it work?
Annual leave is a statutory employee right under Article 109 of the Saudi Labor Law. During the first five years of service the employee earns 21 days per year; this rises to 30 days after completing five continuous years with the same employer. Unused days may be deferred (with the employer's consent) or cashed out at the end of service.
Statutory entitlements (Article 109)
- Under 5 years of service: 21 days/year (1.75 days/month).
- 5+ years of service: 30 days/year (2.5 days/month).
- Days include any official holidays that fall within them.
How does leave accrue?
Leave accrues pro rata month by month from the first day on the job. An employee who has worked 6 months has earned half the annual leave (10.5 days in the first tier, 15 in the second).
Worked example
Employee with 7 years of service who has already taken 12 days this year:
- Tier: 5+ years → 30 days/year
- Monthly accrual = 30 ÷ 12 = 2.5 days/month
- Annual entitlement = 30 days
- Days used = 12 days
- Remaining balance = 30 − 12 = 18 days
Carrying over leave
An employee may defer leave to the following year with the employer's consent. At the end of service, unused days are paid out in cash.
